‘OITNB’ actress to have teen attack charges dismissed
Charges against “Orange Is the New Black” actress Dascha Polanco for allegedly attacking her teen neighbor will be dismissed if she stays out of trouble for six months, prosecutors said Wednesday in Manhattan court.
Polanco, 33, who plays Litchfield Penitentiary inmate Dayanara Diaz on the hit Netflix show, was busted in July for allegedly punching, scratching and pulling the hair of Michelle Cardona, 17.
Assistant District Attorney Christopher Dey said the decision to offer what is known in legal parlance as an adjournment in contemplation of dismissal was based on a thorough investigation, including interviews with the alleged victim.
“She suffered only superficial abrasions and bruising,” the prosecutor said of the teen girl’s injuries.
Dey also said that it was an appropriate disposition given that Polanco had no criminal record prior to the incident.
A glamorous-looking Polanco declined to comment as she left Manhattan Criminal Court wearing her hair in loose ringlets and sporting gold-rimmed sunglasses.
The Brooklyn-bred actress was originally booked on assault, attempted assault and harassment raps for the July 29 melee in her Washington Heights pad on West 190th Street.
It was unclear what led to the alleged beatdown, but Polanco had invited Cardona to her apartment, cops said.
“Ms. Cardona observed the defendant strike Ms. Cardona about the face and head with a closed fist at least three times, pull Ms. Cardona’s hair, and strike Ms. Cardona’s arms with the defendant’s hands and nails,” the criminal complaint alleges.
Defense lawyers for the curvy, Dominican-born beauty have insisted from the start that Cardona was “motivated by the prospects of a payday.”
“She (Cardona) devised a plan to have Ms. Polanco pay her to withdraw the charges, which was furthered by a campaign of harassment directed at Ms. Polanco and her family and jeopardized their safety,” attorney Gerald Lefcourt said in a statement.
“Fortunately, we had irrefutable evidence of the complainant’s misdeeds on tape, including her extortion attempts.”
Polanco has luckily wrapped up her criminal case ahead of the Emmy-winning Netflix series’ Season 4 premiere slated for June 17.
On the show, her character, Diaz, carries on an illicit affair with a prison guard and eventually gives birth to his child.
